Frogit Terms of Use Last Updated: March 27, 2025 Welcome to Frogit! These Terms of Use (“Terms”) are a contract between you and Frogit Pty Ltd (“Frogit,” “we,” or “us”) and govern your access to and use of the Frogit website, mobile application (available for iPhone or Android), or content (collectively, the “Site”) and any sports games, courts, or related services made available through Frogit (collectively, “Games”). Please read these Terms carefully before accessing or using the Site or Games.Terms of Use)
Acceptance of Terms. By accessing or using the Site or Games, or clicking to indicate your consent, you agree to be bound by these Terms as if you had signed them. If you don’t agree, do not use the Site or Games.b) Amendment of Terms. We may amend these Terms at any time. Amendments take effect when we post the updated Terms, unless we specify a later date. Your continued use after posting constitutes consent to the updated Terms.c) Additional Terms. Some features, offers, or services may have additional terms, posted or communicated by us or third parties. These are incorporated into these Terms by reference. In case of conflict, these Terms control unless stated otherwise. The Frogit Privacy Policy is incorporated by reference.Frogit Platforma) Frogit Platform. Frogit enables users to find, book, and play pickup sports games (e.g., tennis, basketball) at courts or facilities operated by third-party venues (“Venues”). We’re a booking tool, not a sports facility or organizer—Venues run the Games.b) Booking Options. You can book Games directly through the Site for a fee set by the Venue, paid at booking or on-site, depending on the Venue’s policy. We may offer free bookings or promotions at our discretion, but availability isn’t guaranteed and can change anytime.c) Game Availability. Game schedules, locations, and fees depend on Venue policies, demand, and other factors (e.g., time of day, court type). We don’t guarantee specific Games or spots will be available—they can change or sell out at any time.d) Use of Frogit. Your account is personal and non-transferable. You can’t let others use it or book Games for commercial purposes. You need internet access to use the Site, and we may test or update features, including including or excluding you from tests without notice.e) Eligibility. You must be 18 or older to use Frogit. We may limit access based on location, age, or other criteria and can terminate your account if you don’t meet them.Fees and Paymentsa) Booking Fees. You pay Venue-set fees when booking through the Site, processed via a valid payment method (“Payment Method”). Fees vary by Game and Venue and may change without notice.b) Refunds. Fees are generally nonrefundable unless the Venue cancels a Game or we specify otherwise at booking. Refunds, if any, come from the Venue, not Frogit.c) Cancellations. Cancel through the Site only—direct cancellations with Venues breach these Terms. Late cancellations or no-shows may incur Venue fees, which you’re responsible for. Check each Game’s cancellation policy on the Site.d) Payment Issues. If payment fails (e.g., expired card), you’re still liable for the amount. We’ll retry your Payment Method and may restrict access if unpaid.Promotionsa) Offers. We may offer free bookings or discounts, subject to additional terms provided at the time. These are non-transferable and void where prohibited. Only one account per user is allowed for promotions.b) Eligibility. We can determine promotion eligibility and cancel offers if you violate these Terms (e.g., multiple accounts). No refunds apply in such cases.Termination by FrogitWe can terminate or suspend your account, bookings, or access to the Site or Games at any time, without notice, for any reason (e.g., fraud, Terms violation). Upon termination, your access ends, and we’re not liable beyond refunding prepaid, unused bookings (if terminated without cause). You can’t re-register if banned.PrivacyOur Privacy Policy (below) explains how we handle your data. Venues get your name and contact info for bookings—check their policies too.Prohibited ConductDon’t: harass users or Venues; impersonate others; share accounts; book directly with Venues outside Frogit; upload harmful content or code; scrape the Site; or use it illegally. We can terminate accounts for violations.User Submissionsa) General. You can post reviews, ratings, or profile info (“User Submissions”). They’re public—don’t share what you want private.b) License. You grant Frogit a worldwide, royalty-free, perpetual license to use, display, and distribute User Submissions for operating and promoting the Site.c) Responsibility. You’re liable for your User Submissions. They must be legal, non-infringing, and yours to share. We can remove or edit them anytime.OwnershipFrogit owns the Site’s content, code, and design (excluding User Submissions). You can’t copy or exploit it beyond personal use.10. Third-Party LinksThe Site may link to Venue sites or services. We’re not responsible for their content or actions—use at your risk.11. DisclaimersThe Site and Games are “as is.” We don’t guarantee availability, safety, or fitness for purpose. Venues, not Frogit, run Games—your participation is at your own risk.12. Assumption of RiskSports have risks (e.g., injury). You assume them by using Frogit. Consult a doctor before playing, and stop if you feel unwell. We’re not liable for Venue quality or your health.13. Limitation of LiabilityTo the fullest extent allowed by law, Frogit isn’t liable for indirect damages or Venue actions. Our liability is capped at $50 or your last three months’ payments, whichever is higher.14. Dispute Resolutiona) Law. Governed by [insert state, e.g., California] law.b) Forum. Disputes go to [state] courts unless we agree otherwise.c) Arbitration. For claims under $10,000, either party can choose binding, remote arbitration via a mutually agreed provider.15. Miscellaneousa) Assignment. We can assign these Terms.b) Severability. Invalid terms are severed; the rest stand.c) Entire Agreement. These Terms are the full deal.d) Claims.
